Terms & Conditions

In order to qualify for the seven year warranty against mechanical failure, the customer must agree to and abide by the following terms & conditions:

1). Compression refrigeration systems require on-going preventative maintenance service in order to operate properly and without issues. Therefore, in order to qualify for the refrigeration or HVAC equipment warranty offered by 404 Refrigeration & HVAC Services, the purchaser of the refrigeration or HVAC equipment must have 404 Refrigeration & HVAC Services perform preventative maintenance servicing on the equipment which was installed on the customer’s behalf, on a schedule of every four months for the period of seven years. The price of the preventative maintenance service will be agreed upon in writing with the owner of the equipment and must be voluntarily adhered to by the owner of the equipment for the length of the seven year warranty period by 404 Refrigeration & HVAC Services in order for the 7 year warranty to stay in effect.

1a). There is no binding preventative maintenance contract required by the purchaser of the new refrigeration or HVAC equipment. Having 404 Refrigeration & HVAC Services perform a preventative maintenance servicing on the equipment every four months for the seven year period, during which the refrigeration or HVAC equipment is warranted against mechanical failure, is completely voluntary on the part of the equipment purchaser. However, in order to qualify for the seven year warranty of the new refrigeration or HVAC equipment being installed on behalf of the equipment owner, a preventative maintenance schedule detailing the 21 preventative maintenance visits necessary over the seven year period from the installation date of the new refrigeration or HVAC equipment must be adhered to by the purchaser of the equipment. Failure of the equipment owner to voluntarily adhere to the preventative maintenance schedule will automatically void the new refrigeration or HVAC equipment warranty on that refrigeration or HVAC equipment, and will alleviate 404 Refrigeration & HVAC Services from any and all financial liability in regards to warranty of the new refrigeration equipment.

1b). The cost of the preventative maintenance service, per visit, will be agreed upon in advance and guaranteed to contractually for the entire term of the 7 year warranty by 404 Refrigeration & HVAC Services. The cost of the preventative maintenance service will not increase over the seven year period of the equipment warranty.

1c). In the future, should the owner of the business sell the business including the equipment, or should the owner of the equipment sell that particular piece of equipment, the seven year warranty on the new refrigeration or HVAC equipment will remain in effect, but only under two conditions:

1c-a). The new owner of the equipment has to voluntarily adopt and adhere to the previously mentioned maintenance schedule as specified by 404 Refrigeration & HVAC Services; this requires that the new owner of the equipment continues to have 404 Refrigeration & HVAC Services perform the preventative maintenance on the refrigeration or HVAC equipment at the business premises where the refrigeration or HVAC equipment was installed; failure to adhere to the previously agreed upon preventative maintenance schedule, or having another company other than 404 Refrigeration & HVAC Services perform preventative maintenance on the machinery will automatically void the warranty as offered by 404 Refrigeration & HVAC Services and alleviate 404 Refrigeration & HVAC Services from any and all financial liability in regards to the warranty of the new or retrofitted refrigeration or HVAC equipment.

1c-b). In the situation where the refrigeration or HVAC equipment has been sold and removed from the premises where the equipment was originally located and installed, and moved to a different location, then the equipment must be located within the service region that 404 Refrigeration & HVAC Services operates within in order for the new equipment replacement warranty to remain in effect. The service region that 404 Refrigeration & HVAC Services operates in is from the City of Calgary to the United States border, and from the provincial border of British Columbia and Alberta to the provincial border of Saskatchewan and Alberta. Moving the equipment out of this service area will automatically void the warranty as offered by 404 Refrigeration & HVAC Services and will alleviate 404 Refrigeration & HVAC Services from any and all financial liability in regards to the warranty of the new or replacement refrigeration or HVAC equipment.

2).  In order to qualify for the new equipment warranty program, the refrigeration or HVAC equipment (i.e. a walk in cooler, or a HVAC system being installed onto existing duct work) that the new mechanical refrigeration or HVAC equipment is being installed into must first pass a thorough mechanical inspection from 404 Refrigeration & HVAC Services. If the equipment (i.e. the walk in cooler, or the HVAC ducting) has other mechanical issues as determined by 404 Refrigeration & HVAC Services, then the mechanical issues must first be repaired, rectified, documented, and signed off on by a qualified representative of 404 Refrigeration & HVAC Services before the new refrigeration or HVAC equipment can qualify for the seven year warranty term. The cost of the new parts and supplies, the cost of the labour to repair the existing infrastructure, and the cost of the labour required to install new parts into the existing infrastructure, will be over and above the cost for the new refrigeration or HVAC equipment and must be paid for by the customer in full before a new refrigeration or HVAC equipment can qualify for the seven year new refrigeration or HVAC equipment warranty.

3). During the course of the seven year new refrigeration or HVAC equipment warranty, while performing the agreed upon preventative maintenance services, if and when 404 Refrigeration & HVAC Services discovers wear or malfunction of an existing part or component of the refrigeration or HVAC system where the equipment was installed, that affects the operation and mechanical functioning of the refrigeration or HVAC equipment, then this worn or malfunctioning part or component is required to be repaired or replaced by 404 Refrigeration & HVAC Services during the preventative maintenance servicing of the machine. A free, no-obligation written quotation of the necessary repair, including all labour costs and parts costs will be provided to the owner of the equipment before any repairs commence.

3a). Failure to have the worn or malfunctioning part or component repaired or replaced by 404 Refrigeration & HVAC Services immediately upon the recommendation of 404 Refrigeration & HVAC Services will automatically void the seven year new refrigeration or HVAC equipment warranty as offered by 404 Refrigeration & HVAC Services and will alleviate 404 Refrigeration & HVAC Services from any and all financial liability in regards to the warranty of the new refrigeration or HVAC equipment.

3b). The parts supplied for the necessary repair must be provided by 404 Refrigeration & HVAC Services to the customer. Any parts found on the refrigeration or HVAC equipment that were not provided by and approved from 404 Refrigeration & HVAC Services after the discovery and documentation of a worn or malfunctioning part or component will automatically void the seven year new refrigeration or HVAC equipment warranty as offered by 404 Refrigeration & HVAC Services, and will alleviate 404 Refrigeration & HVAC Services from any and all financial liability in regards to the warranty of the new refrigeration or HVAC equipment.

3c). The work necessary to repair or replace the worn or malfunctioning parts or components must be performed by 404 Refrigeration & HVAC Services. Getting the work performed by another contractor or person, qualified or unqualified, will automatically void the seven year new refrigeration or HVAC equipment warranty as offered by 404 Refrigeration & HVAC Services, and will alleviate 404 Refrigeration & HVAC Services from any and all financial liability in regards to the warranty of the new refrigeration or HVAC equipment.

3d). In the event that 404 Refrigeration & HVAC Services, during any visit for repair or maintenance of the equipment within which the new refrigeration or HVAC equipment is installed, decides to shut down the refrigeration or HVAC equipment to prevent possible damage to the equipment, then the customer must abide by this decision until such time as the mechanical problem is repaired and resolved by 404 Refrigeration & HVAC Services. Failure to agree to and abide by the decision to shut down the equipment, or re-energizing and turning the equipment back on after 404 Refrigeration & HVAC Services has left the premises will automatically void the seven year new refrigeration or HVAC equipment warranty as offered by 404 Refrigeration & HVAC Services and will alleviate 404 Refrigeration & HVAC Services from any and all financial liability in regards to the warranty of the new refrigeration or HVAC equipment.

4). The purchaser of the new refrigeration or HVAC equipment must sign a printed version of this 7 year equipment warranty stating that they have read and fully understood the terms and conditions of the warranty.
